SF Public Defender Requests Docs from DA
After police misconduct exposed on video surveillance, 13 cases have been dropped
SF Public defender Jeff Adachi sent a letter today to District Attorney George Gascon, requesting a number of documents related to the misconduct investigation at SFPD.
A series of surveillance videos that appear to show discrepancies in officer statements and testimony in a number of drug-related cases have prompted investigations by the FBI, the police department, the district attorney's office and the public defender's office.
Reporters were volleyed between offices at the Hall of Justice yesterday after Adachi held another press conference about the videos, forcing the police department and district attorney's office to issue their own response.
The names of the eight officers are Gregory Buhagiar, Samuel Christ, Raymond Kane, Raul Elias, Robert Forneris, Arthur Madrid, Arshad Razzak and Richard Yick, all of Southern Station (which is also based out of 850 Byrant, aka the Hall of Justice).
The public defender's office also said today a total of 13 cases have been dropped as a result of the videos, although the district attorney's office has disputed that in at least one case. In that case, reported yesterday, charges were dropped because of concerns about disclosing the identity of a confidential informant, not the video evidence, the office said.
The public defender's office said eight of those 13 cases, including five public defender cases and three private attorney cases, were dropped today. Those include:
- A 23-year-old man and his co-defendant who were both charged with misdemeanor grand theft at Sixth and Market in January
- A 52-year-old man charged with multiple felony counts of heroin and cocaine possession for sale in October in the Tenderloin
- A Henry Hotel resident charged with felony possession of crack for sale in July in front of the hotel
- A 35-year-old man and his 55-year-old co-defendant who were both charged with felony marijuana sale after a buy-bust operation in Februry at Sixth and Market
- A 43-year-old man charged with second-degree auto burglary and accepting stolen property in October at 10th and Bryant
- A 28-year-old man charged with two counts of drug sales in September
Spokeswoman Erica Derryck declined to comment Tuesday, but said her office planned to offer up their response to Adachi tomorrow.
"We really are not going to get into the weeds of any of those things until tomorrow, so keep your dance card clear," she said.
Godown has said he's reviewing the training for officers and has placed all of the officers under investigation in administrative assignments.
"The officers are entitled to due process," spokesman Lt. Troy Dangerfield said.
