San Jose Man Beaten by Police in Mistaken Identity Case

Several San Jose police officers remain on duty this week following the apparently accidental beating of a man they thought was the suspect in a drug case.

The San Jose Mercury News originally reported that police beat and handcuffed the 23-year-old San Jose man:

Walking into his neighborhood convenience store for a $1 lottery ticket, Henry Stevens Amador hoped it would be his lucky day. But instead of walking out with three cherries and a thousand bucks, Amador was violently busted by San Jose police officers.

Afterward, a sergeant reportedly unlocked the handcuffs, helped clean the blood off his face and apologized.

Amador required eight stitches, according to the paper, and may be planning to sue the San Jose police department.

Meanwhile, police told The Bay Citizen that the officers involved remain on duty while the department conducts an internal investigation. The details will not become public record until the probe is complete.

"They were out there on an operation. They had an opportunity to encounter Mr. Amador under unfortunate circumstances," said officer Jose Garcia. "This is something that we treat seriously, we are looking into and that's why the Internal Affairs Unit has launched an investigation to determine what happened and who did what and if there's anything we can improve upon."

The officers, along with members of a task force comprised of several other agencies, were participating in the operation. San Jose police have refused to release footage of the incident, caught on a store surveillance camera.

The store said Wednesday that police have their only copy of the video. The camera overlooks the footpath outside the store on Capitol Expressway, where the incident occurred.
